AMERICAN VETERANS APPRECIATION AR-15 STYLE
FIREARM GIVEAWAY

No purchase or payment is necessary to enter or win the Americas Web Radio Veterans
Giveaway. A purchase or payment of any kind will not increase your chances of winning.
This Offer is not valid in the state of Rhode Island, the District of Columbia and is void
where prohibited by Federal, State and/or local Law, Territorial Laws, Rules and/or
Regulations.

By entering and participating in the Americas Web Radio “Great Veteran Giveaway” (may be
referred to herein as the “Americas Web Radio Giveaway” or the “Giveaway”) each participant
accepts and agrees to these Official Rules and the Decisions of the Sponsor (as defined below),
which are binding and final in all respects. You agree that by entering this Giveaway, that you
are waiving any and all rights, cause of actions and/or claims, whether known or unknown at the
time, to Appeal, contest or otherwise challenge the Sponsor’s Decision for any reason, including,
but not limited to, that of a mistake of fact, to be interpreted in its broadest sense for legal
interpretation of this waiver. That this is a knowing waiver and is in consideration of being
permitted to enter into this Giveaway, which you hereby acknowledge, shall be good and
valuable sufficient consideration.

Furthermore, that by entering this Giveaway, you are certifying that at the time of the entry into
this Giveaway, and at the time of the anticipated possession, if chosen the winner, that you are an
eligible person of the legal age of majority in your jurisdiction, State, Territory, and/or according
to local law and, are able and legally permitted to possess and qualify under Federal, State and
Local Laws to own and possess a firearm as set forth herein in the jurisdiction of possession.
You furthermore, certify that all of the information provided is true and correct to the best of
your knowledge, and that you consent to the Sponsor, its agents, independent contractors and/or
employees, verifying such information provided in the Entry Form.

Additionally, you certify that there is no reason or cause, known to you at the time of the
submission of your entry and at the time of the award/possession anticipated, that you will not
pass a Federal Background Check as required, prior to the firearm being transferred to you and
your taking possession of the firearm, if you are determined and chosen to be the winner of the
Giveaway. That this Giveaway will be handled and conducted through a Federal Firearms
Licensed Dealer, OMEGA DEFENSE SYSTEMS, LLC, 601 Townsend Road, Cocoa, Florida,
32926 and, will be subject to any and all regulations, Federal, State and Local, for the transfer to
the Winner. That if for any reason, the Winner chosen is unable or unwilling to acquire and
possess the firearm, as solely and exclusively determined by the Federal Firearms Licensed
Dealer after the Sponsor’s Decision is made, the Sponsor will chose another entry and make the
award, until the person who wins is an acceptable candidate.

This offer is subject to any and all applicable Federal, State and Local Laws Rules and
Regulations and, is void in any and all states and or territories, where prohibited or restricted by
law. All Entrants must be of legal age to possess the firearm in the jurisdiction/State where
possession will be at the time of the possession and be permitted to possess a firearm at the time
of the actual transfer of the firearm to the winner, and the determination shall be at the sole and
exclusive discretion of the Sponsor and Federal Firearms Licensed Dealer. This decision is also
protected by and subject to the above waiver by the entrant.

-Giveaway Description
AMERICAS WEB RADIO, INC., a Georgia Corporation, (the “Sponsor”) is sponsoring the
Americas Web Radio, Inc.’s, “Veteran’s Appreciation Radio Giveaway”, which offers the
Giveaway of the prize of one AR-15 Style Firearm, with one 7 round magazine (or legally
available and allowed magazine in the jurisdiction where possession will be), referred to herein
as the “firearm prize” or the “prize,” during the Giveaway Period (as defined and set forth
below). In order to be an entrant into the giveaway, the entrant must be a United States Veteran
who has been Honorably Discharged and must provide present proof of same to the Sponsor at
the time of Entry. Each entrant shall fill out the online form as required, and submit their
Honorable Discharge, Copy of their DD214, Copy of their State Issued Drivers License, Copy of
their VA Card, and a Copy of their Military ID, either expired or current, all of which are subject
to independent verification by the Sponsor, prior to the award being issued. You hereby, by
entering and by submitting the Entry into the Giveaway, give permission and consent to the
Sponsor to be able to verify the information provided from the Federal Government Agencies, as
to the Sponsor, shall be appropriate, sufficient and necessary, in their sole an exclusive
discretion to do same. You may only submit One Entry per Giveaway and only ONE ENTRY
PER VETERAN. Anyone who submits more than One Entry, shall, at the sole and exclusive
discretion of the Sponsor, be disqualified from winning the Giveaway, and/or from any further
Giveaways that the Sponsor may in the future have.

One prize winner will be selected in a drawing conducted by the Sponsor from all eligible entries
submitted during the Giveaway Period. See “Timing and How to Enter” for details. The
approximate retail value of the firearm prize offered in the Giveaway is $1,000.00 as listed in the
prize description on www.Americaswebradio/Giveaway throughout the Giveaway Period. The
odds of winning the Americas Web Radio Giveaway depends on the number of eligible entries
received in the Giveaway drawing.

-Eligibility
The Americas Web Radio Giveaway is open only to Legal Residents of the Fifty (50) United
States (except as otherwise stated in these Rules), 18 years of age or older at time of entry and
legally eligible to own and possess a firearm, as set forth herein. Directors, officers, employees
and contractors of the Sponsor or its affiliates, and members of their immediate families (i.e.,
spouse, children, parents, and siblings), are not eligible to participate in the Giveaway. Residents
of the states of Rhode Island, New York and the District of Columbia, are not eligible to enter or
participate in the Giveaway unless permitted by law.

-Timing and How to Enter
The Americas Web Radio Giveaway period begins on January 15, 2024, at 12:00 a.m. ET and
ends on March 15, 2024, at 11:59 p.m. ET (the “Giveaway Period”). Each eligible participant’s
Entry properly completed and received during the Giveaway Period will be placed into the
Giveaway drawing. During the Giveaway Period, the only way to enter is:

-Online Entry Form: Submit your initial entry by completing the required information in the
entry form found at www.AmericasWebRadio.com/Giveaway. You will be required to provide
your first, middle Initial and last name, your email address, home address (street, City, State, Zip
Code), and phone number, and confirm you are at least 18 years of age or older at the time of the
submission of the entry. Entrants will be required as per the Entry Form to reveal their favorite
Americas Web Radio Show and explain why they enjoy it. See Entry form for the specific
requirements. Completed Entry Forms must be submitted ONLY VIA THE ONLINE ENTRY
FORM. Entrants must provide the Sponsor with accurate information on the entry form.
Sponsor reserves the right to disqualify a participant if inaccurate or incomplete information is
suspected for any reason. Decisions of the Sponsor are final and non-appealable under any
circumstances and controlled by the knowing waiver contained herein. Only ONE ONLINE
ENTRY will be allowed per person. Sponsor reserves the right to disqualify any participant for
making additional online entries into the Giveaway not in accordance with these Rules.

Online entries will not be eligible to win if the participant does not have a valid e-mail address at
the time of submission and a valid e-mail address at the time of the awarding of the Giveaway.
Any attempt by a Giveaway participant to obtain and/or submit more than the ONE entry by
using multiple or different identities or email addresses will void that participant’s entries and the
entrant may be disqualified from the Giveaway and any and all future Giveaways, if any.

Sponsor is not responsible for any incomplete, late, lost, misappropriated, illegible, damaged, or
misdirected entries, nor for failure to receive online entries due to transmission failures or
technical failures of any kind, including, without limitation, malfunctioning or unavailability of
any network, platform, hardware or software, whether originating with sender or Sponsor.

-Winner Selection and Notification
The winner of the Americas Web Radio Giveaway will be selected by the Sponsor after
consideration of the Entries in accordance with the terms of this Giveaway and in Compliance
with all appropriate and applicable Federal, State and Local Laws, Rules, and Codes, chosen and
will be announced on April 1, 2024, from among all eligible entries received by Sponsor during
the Giveaway Period.

The winner of the Giveaway will be notified by Sponsor by phone and/or email at the phone
number and email address provided on the entry form within 1 – 3 business days after the Award
Winner is chosen by the Sponsor. In addition, the winner’s name will appear in the winner’s list
available on www.AmericasWebRadio.com/Giveaway after the Winner is chosen. Once Sponsor
makes an effort to contact a winning participant, the winner must communicate with Sponsor
promptly within the time frame herein or forfeit the firearm prize, as described below. Sponsor
is not responsible if a potential winner notification is not received for any reason or returned as
undeliverable. For instance, Sponsor is not responsible if a potential winner does not receive his
or her winner notification because inaccurate email or telephone contact information was
provided at the time of entry or such information is not current at the time of the awarding of the
Giveaway. If a potential winner cannot be contacted, or fails to reply to the notification email
and/or phone message as instructed within fifteen (15) days of Sponsor’s original notification
attempt, he/she automatically forfeits the firearm prize without further notification being given
nor required. In addition, a winner may decline the firearm prize for any reason and the prize
will be forfeited. In the event of any forfeiture, or the failure of the Winner to qualify for any
reason, Sponsor may select a new winner following the Giveaways criteria process.

-Requirements of the Winner
Upon Sponsor’s confirmation of contact, a potential winner is subject to verification by Sponsor
and the Federal Firearms Licensed Dealer, whose decisions are final and binding in all matters
related to the Giveaway and subject to the above waiver provisions for objection. A participant
is not a winner of the firearm prize, even if participant receives notification saying he or she won,
unless and until participant’s eligibility and compliance with these rules, as well as applicable
laws, have been verified and participant has been notified that verification is complete. The
Giveaway winner must pass appropriate background check(s), and comply with applicable
federal, state and local laws in order to take possession of the firearm prize, and pay any required
transfer fees or verification fees, if any. Only the winning participant may take possession of the
firearm. Under no circumstances will any surrogate or other person be permitted to take
possession of the firearm. Transfer of the firearm prize shall be conducted through a Federal
Firearms Licensed Dealer that holds a valid federal firearms license (FFL), in strict compliance
with all applicable federal, state and local laws. At any time prior to fulfillment of the prize, if
the Winner (I) fails to submit to any required background check(s) for firearm possession, (ii) is
barred from obtaining or using a firearm, (iii) otherwise fails to comply with applicable laws or
regulations, or (iv) fails to comply with reasonable requests to cooperate to obtain the required
information and/or documentation for the transfer of the firearm, the winning participant will be
declared ineligible and the firearm prize will be forfeited. Another winner will be selected to
receive the firearm prize, as described above. By entering the Giveaway, you certify and
acknowledge that you are not legally prohibited from owning or taking possession of a firearm.

Furthermore, The Winner hereby consents that he/she gives permission to, photograph and/or use
a likeness of him/her as the Winner, without any charge or compensation. Winner hereby
consents to the use of his/her name and likeness or photograph in any and all advertising,
including posting on any and all social media accounts and website(s) utilized by the Sponsor,
without further consent nor any charge or compensation. By accepting the Giveaway prize, the
winner agrees to the use of his or her name or photograph, or likeness in the official, publicly
available, list of Giveaway winners, and in the publicity and advertising of the Sponsor,
Americas Web Radio, Inc., without any compensation, as described in “Personal
Information/Privacy” below.

-Firearm Prize Details
The Americas Web Radio Veteran Appreciation Giveaway Firearm prize is one AR-15 Style
Firearm with approximate retail value $850.00 (USD) and one 7 round magazine (subject to the
jurisdiction limitations imposed where the firearm will be possessed). Further prize description
is provided at www.AmericasWebRadio/Giveaway. The winner of the firearm prize is
responsible for all expenses (other than shipping) associated with the prize, including, without
limitation, all federal, state and local taxes. The prize is not transferable or assignable and may
not be exchanged for cash value. No substitution of the firearm prize for cash or other goods and
services will be made except, at Sponsor’s sole and exclusive discretion. Sponsor reserves the
right to substitute the listed firearm prize for one of approximate equal value for any reason.

THE FIREARM PRIZE IS GIVEN AWAY BY SPONSOR “AS IS.” SPONSOR DOES NOT
MAKE AND HEREBY DISCLAIMS ANY AND ALL WARRANTIES, WHETHER
EXPRESS, IMPLIED, OR STATUTORY (INCLUDING WITHOUT LIMITATION ANY
IMPLIED OR STATUTORY WARRANTY OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT) WITH REGARD TO THE
FIREARM PRIZE.

-Limitations of Liability and Release
By participating in the “Americas Web Radio Giveaway”, each participant agrees to release, hold
harmless, defend and indemnify Sponsor, its affiliates, directors, officers, employees, agents,
representatives, successors and assigns (collectively, the “Released Parties”) from and against
any and all claims, actions, proceedings, and liability for any damages of any kind or nature,
including, but not limited to, any and all Third Parties; any and all expenses, fees, injury or losses
sustained in connection with entrant’s participation in the Giveaway, or the use of the prize in
any manner inconsistent with Federal, State, and Local Laws, Rules and Regulations for receipt
of a firearm prize. Sponsor is not responsible for and assumes no liability for (1) damage caused
to participant’s or any other person/entity’s computer hardware, software or communications
network, regardless of cause; (2) any incorrect or inaccurate information, whether caused by
participant, printing errors or by any of the equipment or programming associated with or utilized
in the Giveaway; (3) technical failures of any kind, including, but not limited to malfunctions,
interruptions, or disconnections in internet connections or network hardware or software; (4)
unauthorized human intervention, in any part of the entry process or the Giveaway; and (5)
technical or human error which may occur in the administration of a Giveaway or the processing
of entries. IN NO EVENT WILL THE RELEASED PARTIES BE LIABLE FOR ANY
DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL,
CONSEQUENTIAL OR PUNITIVE DAMAGES. Some jurisdictions do not allow the
limitations or exclusion of liability for incidental or consequential damages, so the above may not
apply to a particular participant in a jurisdiction that does not allow the above limitations or
exclusions. Sponsor expressly assumes no responsibility for the possession, handling or use of a
firearm prize won through the Giveaway. The winner is responsible for the proper safe handling,
use, training and storage of a firearm prize, which includes obtaining proper instruction for the
safe use and handling of the firearm. BY RECEIPT OF ANY FIREARM PRIZE, THE
WINNER ASSUMES SOLE AND EXCLUSIVE LIABILITY FOR, AND AGREES TO
RELEASE, DEFEND, HOLD HARMLESS AND INDEMNIFY THE RELEASED PARTIES
FROM AND AGAINST, ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT
LIMITED TO, PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY,
AND RELATED DAMAGES, OBLIGATIONS, LOSSES, COSTS AND EXPENSES
(INCLUDING BUT NOT LIMITED TO ATTORNEY FEES COURT COSTS OR OTHER
EXPENSES ARISING OUT OF OR IN CONNECTION WITH THE USE), ARISING OUT OF
OR IN CONNECTION WITH, CLAIMED TO BE CAUSED BY PARTICIPATING IN THE
GIVEAWAY OR THE ACCEPTANCE, POSSESSION, LOSS, USE OR MISUSE OF ANY
FIREARM PRIZE.

-Additional Terms
The Sponsor reserves the right to cancel, suspend and/or modify the Americas Web Radio, Inc.
Giveaway for any reason and/or no reason. Additionally, the Americas Web Radio Giveaway
may be cancelled, suspended and/or modified due to fraud, technical failures, computer virus,
bug, tampering, force majeure (as defined below) or any other factor which impairs the integrity
or proper functioning of the promotion, as determined by Sponsor, in its sole and exclusive
discretion. If terminated, Sponsor may, in its sole and exclusive discretion, determine a winner
from among all non-suspect, eligible entries received up to the time of such action. Notice of
such action will be posted on www.AmericasWebRadio.com/Giveaway. The term ‘force
majeure’ refers to any of the following events and/or circumstances: acts of God, accident, riots,
war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of
communication facilities, breakdown of web host, breakdown of internet service provider,
natural catastrophes, governmental acts or omissions, changes in laws or regulations, national
strikes, fire, explosion, generalized lack of availability of raw materials or energy. This
Giveaway is subject to all applicable laws. Sponsor can modify these Official Rules in any way at
any time, provided Sponsor gives reasonable notice and posts same to its website.

Sponsor reserves the right to disqualify any entry from the Giveaway if in its sole and exclusive
judgment participant has not complied with these Official Rules. Without limitation, an entry
will be disqualified, at the sole and exclusive discretion of Sponsor, if participant (i) attempts to
tamper with the entry process or enter the Giveaway through any means other than as described
in these Official Rules; (ii) provides information that is inaccurate or fraudulent; or (iii) attempts
to disrupt the Giveaway or circumvent the terms and conditions of these Official Rules. Use of
any automated system to participate is prohibited and will result in disqualification. In the event
of any fraudulent conduct, Sponsor expressly retains the right to pursue all available legal
remedies against a participant under applicable law.

Except as otherwise provided in these Official Rules, use of the website
www.AmericasWebRadio.com is subject to the terms and conditions set forth in the Terms of
Use.

-Personal Information/Privacy
Sponsor respects the privacy of all participants. Except for use of the Name and Town of a
winning participant, as described below, Sponsor will not sell, share or disclose identifying
personal information of any participant to a third party, except to the Federal Firearms Licensed
Dealer as set forth herein above, for use in the transfer of the firearm, without the participant’s
prior consent or unless required by applicable law, Court order or law enforcement demand, in
accordance with all applicable laws.

By entering a Giveaway, each participant agrees and grants Sponsor and/or its agents the right to
use, in the event that participant is selected as the winner, the participant’s First and/or Last name
or Initial and Town and State of residence on Sponsor’s website or affiliated websites and in any
and all publicity and advertising for Sponsor, without any further attribution, notification or
compensation to the winning participant (except if the participant is a resident of Tennessee or
resides in a jurisdiction where such use is prohibited by law). In any event, the winner agrees
that the Sponsor may include his or her name and town and state of residence in the list of
Giveaway winners available on www.AmericasWebRadio.com/Giveaway or by mail as set forth
below. With the exception of the Giveaway winners list, Sponsor shall have no obligation
(express or implied) to use any information about a winning participant in any manner described
herein, and no participant shall be entitled to any damages or other relief by reason of Sponsor’s
use or non-use of any such information.

A participant may from time to time receive information directly from Sponsor, if the participant
affirmatively indicates that he or she would like to be notified of future Giveaways and special
promotions from Americas Web Radio, Inc. A participant may unsubscribe from such emails at
any time upon request. Instructions for unsubscribing may be found in the email from
www.americaswebradio.com. Except as otherwise stated in these Official Rules, personal
information collected from participants is subject to Sponsor’s Privacy Policy.

-Governing Law and Dispute Resolution
These Official Rules and all matters relating to the Giveaway are governed by and shall be
construed in accordance with the laws of the State of Georgia without giving effect to any choice
of law or conflict of law rules (whether of Georgia or any other jurisdiction), which would cause
the application of the laws of any jurisdiction other than Georgia to be applied in any and all
actions or claims. Each participant by entering, acknowledges, consents and agrees that the sole
and exclusive venue for any litigation arising out of, or in connection with or related to this
Giveaway or these Official Rules, shall be solely and exclusively in State or Federal court located
in Fulton County, Georgia, and hereby consents to the jurisdiction of same. If there is a dispute
regarding the identity of a participant, the entry will be deemed submitted by the person in whose
name the submitting email account is registered. The invalidity or unenforceability of any
provision of these Official Rules shall not affect the validity or enforceability of any other
provision of the Rules. In the event that any such provision is determined to be invalid or
otherwise unenforceable, these rules shall be construed in accordance with their terms as if the
invalid or unenforceable provision were not contained therein.

List of Winners. For the Winner’s name (first name, last initial), city and state of residence send
a self-addressed, stamped envelope to Americas Web Radio, Inc.: Americas Web Radio
Giveaway Winners’ List, 2102 Macy Dr., Roswell, Georgia 30076. The Winner’s name will be
available within 30 days after the Winner is decided and announced as set forth herein above, by
the end of the contest decision and the announcement date.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN
ENTRANT, TO IMPERSONATE A VETERAN, SUBMIT FALSE, MISLEADING OR
ALTERED DOCUMENTS, TO DELIBERATELY DAMAGE, DESTROY, TAMPER
WITH OR VANDALIZE THIS WEBSITE OR INTERFERE WITH THE OPERATION
OF THE GIVEAWAY, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND
SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND WILL HAVE THE
RIGHT TO DILIGENTLY PURSUE ANY AND ALL REMEDIES, INCLUDING THAT
OF CRIMINAL PROSECUTION AGAINST ANY SUCH INDIVIDUAL(S),
CORPORATION OR ENTITY, TO THE FULLEST EXTENT OF THE LAW.
